Counterfeit and Prohibited Items Policy
Effective date: 22 August 2026, version 0.1 (draft). This policy forms part of the Trademeup Terms of Service. Violations lead to measures under the Exclusion and Sanctions Policy (sanctions.md).
1. Principle
Only genuine items within the TCG scope may be offered on Trademeup: single cards, sealed products (boosters, displays, decks, boxes), professionally graded cards (e.g. PSA/BGS/CGC), bundles and TCG accessories (sleeves, toploaders, binders, playmats and the like).
With every listing, the seller warrants that the item is genuine, that the seller owns it or is entitled to sell it, and that the listing complies with this policy.
2. Prohibited: Counterfeits and Deception About Authenticity
Zero tolerance. The following in particular are prohibited:
- counterfeits of any kind (fake cards, fake sealed products, fake grading cases or labels, manipulated certificate numbers);
- proxies, reprints, custom cards, "replicas" or "oricas" where they are offered as originals or where confusion with originals is possible; labelling an item as a "proxy" does not make the sale of trademark-infringing reprints permissible, and such items are generally not admitted on the Platform;
- altered cards whose condition or identity is concealed (e.g. recoloured edges, removed stamps, "rebacked" cards) without an express, clearly highlighted disclosure;
- resealed or weighed products offered as factory sealed or untampered; resealing opened products is prohibited in general, as is selling pre-sorted/weighed boosters without a clear disclosure;
- listings with misleading condition or grading claims (e.g. incorrect PSA grade, photo of a card other than the one delivered).
Confirmed counterfeits result in immediate removal of the listing; intentional conduct results in permanent suspension. Pending payouts may be withheld until the matter is clarified (see sanctions.md). We reserve the right to inform rights holders and law enforcement authorities.
3. Prohibited: Goods Without the Right to Sell
- stolen goods or goods derived from other criminal offences;
- items in which the seller has no ownership or power of disposal (e.g. consignment goods without authority, found property);
- items whose sale violates contractual or statutory prohibitions (e.g. samples not intended for sale, "not for resale" products, embargoed pre-release products before the official release date where their trade is prohibited);
- digital codes or accounts whose resale is prohibited by the publisher's terms.
4. Prohibited: Items Outside the TCG Scope
All items outside the scope described in Section 1 are not admitted, in particular:
- other collectibles without TCG relevance (coins, stamps, general sports memorabilia), electronics, clothing without a TCG licence connection;
- services (e.g. "grading services", "pack openings", raffles, "mystery" products without a specific description of contents, chance-based offers);
- weapons, prescription or illegal substances, content harmful to minors, and all other legally prohibited goods;
- vouchers, currencies, crypto-assets, financial products.
5. Prohibited Listing Practices and Conduct
- price fixing, shill bidding, artificially inflating one's own index or rating, fake orders;
- circumventing the Platform (initiating via the Platform, concluding outside it to avoid fees or Buyer Protection), soliciting direct payments outside checkout;
- contact details, external links or advertising in listings where they serve circumvention;
- multiple accounts to evade measures.
6. Reporting and Updates
Violations can be reported via the Platform's reporting system (report reasons include "counterfeit", "prohibited item", "wrong category") or by e-mail to [email protected].
We may amend this policy where new forms of abuse emerge or legal requirements so demand; Section 20 of the Terms (amendments) applies.
